Ø By engaging the services of Sparky Connects Electrical (hereinafter referred to as "the Company"), the Customer acknowledges and agrees to comply with and be bound by these Terms and Conditions, forming a legally enforceable agreement.
Ø This offer ends on the 31st of March at 11:59pm.
Ø All quotes must be finalised within this period for the offer to be redeemable, but services do not need to be completed.
Ø Quotations provided by the Company remain valid for the duration of the promotion.
Ø All quoted prices are inclusive of GST unless explicitly indicated otherwise.
Ø This Promotional Price does not accommodate for any complications. Additional charges may arise due to diagnostics, unforeseen circumstances, complications, or variations requested by the Customer. The Company shall promptly communicate such additional charges and obtain explicit Customer approval prior to commencing any further work.
Ø A deposit equivalent to 20% of the total quoted amount is required prior to commencement for projects exceeding $1,000, unless an alternative arrangement has been agreed upon in writing.
Ø Full payment must be rendered within fourteen (14) days of the invoice date.
Ø Payments overdue by more than thirty (30) days from the invoice date will incur a late payment fee calculated at 5% per month, accruing monthly until full settlement.
Ø Acceptable payment methods include direct bank transfer, credit card transactions, or cash.
Ø The Customer is required to provide a minimum notice period of forty-eight (48) hours for any cancellation or rescheduling of scheduled services.
Ø Failure to provide adequate notice will result in a cancellation fee amounting to either 10% of the total quoted price or a minimum charge of $100, whichever amount is greater.
Ø The Company provides a twelve (12) month workmanship warranty commencing from the date of service completion.
Ø Manufacturer warranties apply solely to supplied materials and equipment; the Company shall assist the Customer in processing warranty claims; however, final determinations are solely at the manufacturer's discretion.
Ø The warranty will become void if defects or damages result from Customer misuse, negligence, unauthorized modifications, external factors, or lack of appropriate maintenance.
Ø The Customer shall ensure safe, unobstructed access to the site during scheduled service appointments.
Ø The Company reserves the absolute right to cease operations immediately upon identifying unsafe working conditions. Delays arising from unsafe conditions are chargeable at standard hourly rates.
Ø Customers must disclose all known hazards or relevant information before commencement of services.
Ø The Company's liability shall strictly be limited to the correction of defective workmanship or replacement of faulty materials directly supplied by the Company.
Ø Under no circumstances shall the Company be held liable for indirect or consequential losses, including, but not limited to, loss of income, profits, data, or business interruption.
Ø The Customer shall indemnify and hold harmless the Company against any claims, demands, or liabilities arising from circumstances or site conditions beyond the Company's reasonable control.
Ø Customer information will be stored securely and utilized solely for the purpose of service provision and compliance with legal obligations.
Ø Personal information shall not be shared with any third party without explicit consent from the Customer, except as legally required.
Ø The Company guarantees compliance with all relevant Australian Standards, specifically AS/NZS 3000 (Wiring Rules), applicable NSW legislation, and regulatory guidelines.
Ø Upon completion of relevant services, the Company shall issue a Certificate of Compliance for Electrical Work (CCEW), as required by law.
Ø The Company reserves the right to amend these Terms and Conditions at any given time. Such amendments shall take effect immediately upon their publication on the Company's website or upon direct notification to the Customer.
Ø In the event of any dispute arising, both parties agree to first attempt to resolve the issue amicably through good faith negotiation.
Ø Should negotiation fail to resolve the dispute, both parties agree to pursue mediation prior to initiating any formal legal proceedings.
Ø These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject exclusively to the jurisdiction of the courts of New South Wales.
Ø By engaging Sparky Connects Electrical, the Customer expressly acknowledges, understands, and accepts all Terms and Conditions outlined above.
